In today's global economy, it is imperative that nations take cognizance of the growing need for suitable and effective environmental laws so as to protect our fragile eco system. The urgency and immediacy of international environmental laws and environmental law firms are felt as we see our entire eco-system falling victim to callous organizations and people.

The Environmental Quality Improvement Act, Environmental Education Act and the Environmental Protection Agency (EPA) were passed along with the National Environmental Policy Act (NEPA) in 1970 in the US. These federal enactments ensured that the environment was protected from private and public actions that inflicted harm on the eco-system. The EPA is entrusted with the responsibility of monitoring and analyzing the environment and devising policies for pollution control. The NEPA is considered a landmark environmental legislation passed by the Congress so far. It apprises governmental agencies of the repercussions of their decisions on the environment.

The Pentagon has proposed changes to ease the environmental laws on the grounds that it affects military readiness. Since 2002 there have been repeated claims for exemptions and flexibility and easing of environmental laws that involve costly cleanup of military ranges. Congress has approved 5 of the 8 changes that the Pentagon has sought. Environmentalists and many environmental law firms argue that the military is seeking to make changes to the environmental laws that are necessary for the preservation of the nation's resources.

Internet Law

Internet law has no history to fall back upon unlike other areas of commerce. Internet law or cyber laws that govern conduct and commerce in cyberspace need to address the growing concerns of trademark and copyright infringement. The Internet or virtual world has come into its own and with it have come certain problems peculiar to the medium. Effective Internet laws on pertinent issues are imminent. Copyright concern is an important facet of any cyber law. An important aspect in the creation of a web site is the domain name. Disputes over domain names have created controversies and lawsuits. This is another area where clearer cyber laws need to be enforced. Trademark infringement is a ruse to deceive the consuming public that the products or services are the same as that of the trademark owner. The legality of links is another bone of contention for cyber law framers. Linking constitutes the heart and soul of the Web. Providing a HREF link cannot be seen as infringement since it is akin to merely providing the web address. But links can be used in ways that would constitute defamation or unfair competition laws. There is little on Internet law in the context of Internet defamation.

Another area of Internet law that is coming in for revamp is the use of outsourcing services. India is likely to see tighter data protection and privacy regime this year. This law is likely to be passed in the new session of parliament that will be in place after the elections. The Indian government is coming under pressure from BPO operations to pass the data protection law so as to have in place a statutory mechanism in case of breach of data. This law may seek to conform to the European Union's Data Protection Directive and the Safe Harbor privacy principles of the U.S.
